Terms & Conditions
These terms govern your use of this website. They are deliberately short on legal shorthand & clear about one thing in particular: booking our venue is governed by a separate signed agreement, not by this page.
1. Agreement to These Terms
By visiting thegroveseason.com, submitting an inquiry through it or otherwise using this website, you agree to these Terms & Conditions. If you do not agree with them, please do not use the site.
These terms apply to everyone who uses the website — couples researching a venue, guests looking up directions, photographers checking rental availability, vendors & anyone simply browsing.
2. Who We Are
The Grove Season is an event venue & creative content studio at 2820 Middle Country Road, Lake Grove, New York 11755. In these terms, "we," "us" & "our" mean The Grove Season, & "you" means the person using this website.
3. Using This Website
You may use this site to learn about our venue, view our work, submit an inquiry, request a tour & contact us. You agree not to:
- Use the site for any unlawful purpose, or in a way that could damage, disable or impair it.
- Submit false, misleading or fraudulent information through our forms.
- Attempt to gain unauthorized access to any part of the site, its servers or any connected system.
- Use automated systems to scrape, harvest or copy content from the site.
- Copy, reproduce or republish our photography, copy or design without written permission.
- Use the site to send unsolicited commercial messages to us or to anyone else.
We may suspend or restrict access to the site, in whole or in part, at any time & without notice.
4. Inquiries, Bookings & the Rental Agreement
This is the most important section on the page, so it is worth stating plainly.
Submitting an inquiry does not book a date
Completing our inquiry form, requesting a tour or exchanging emails with us creates no reservation, no hold & no contract of any kind. Dates remain available to other clients until a written rental agreement is signed & the required deposit is received.
Your booking — including pricing, deposits, payment schedule, cancellation, access times, insurance, alcohol service, vendor requirements, damage & every other operational term — is governed by that signed rental agreement, not by this website. If anything on this site conflicts with your signed agreement, the signed agreement controls.
Information published on this site about inclusions, amenities, availability, capacity or process is provided to help you decide whether to inquire. It is general information, not an offer, & it does not form part of any contract between us.
We reserve the right to decline any inquiry or booking request at our discretion, subject to applicable anti-discrimination law.
5. Pricing & Availability
Rates depend on the date, the day of the week, the season, the length of your booking & the services requested. Any pricing we send you is valid for the period stated in that communication, & is subject to availability until a rental agreement is signed.
We work to keep information on this site accurate & current, but availability changes continually & descriptions may become out of date. We do not warrant that the content of this site is complete, accurate or current at any given moment, & we reserve the right to correct errors or update pricing at any time.
6. Intellectual Property
All content on this site — including photography, video, written copy, the design of our seasonal installations, page layouts, graphics, the name "The Grove Season" & our logo — is owned by us or used with permission, & is protected by copyright, trademark & other laws.
You may view the site, share links to it & print pages for your own personal, non-commercial planning. You may not copy, reproduce, modify, distribute, publish or use our content for commercial purposes without our prior written permission.
Our seasonal installations are original design work. Photographing them during a visit or a booking is welcome & expected. Recreating them commercially, or presenting our photography as your own work, is not.
7. Photography & What You Send Us
When you send us a message, review, photograph, video or any other material, you keep ownership of it. You grant us a non-exclusive, royalty-free permission to use it in connection with operating & marketing the venue — for example, sharing a photo of your event to our social media or quoting a review on our website — unless you tell us in writing that you would prefer we did not.
You confirm that anything you send us is yours to share, that it does not infringe anyone else's rights, & that it is not unlawful or defamatory.
Our own use of photography taken at the venue, including images that show identifiable guests, is described in our Privacy Policy & governed by the terms of your rental agreement.
8. Vendors & Other Websites
We recommend caterers, planners, photographers, florists & bar services who have worked well in our space. A recommendation is not a guarantee, an endorsement of their contract terms or an assumption of responsibility for their work. Any agreement you make with a vendor is between you & that vendor.
Our site links to other websites, including social media platforms, mapping services & vendor sites. We do not control those sites & are not responsible for their content, availability or practices.
9. Disclaimers
The website is provided on an "as is" & "as available" basis. We do not warrant that it will be uninterrupted, error-free or free of harmful components, & we do not warrant that the information on it is complete or current.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose & non-infringement.
Nothing in this section limits any warranty or right that cannot be excluded under New York law.
10. Limitation of Liability
To the fullest extent permitted by law, The Grove Season, its owners, employees & contractors will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of, or inability to use, this website.
Our total liability arising from your use of this website will not exceed two hundred dollars ($200.00). This limitation applies to the website only. Liability arising from an actual booking is addressed in your signed rental agreement, which is a separate contract.
11. Indemnification
You agree to indemnify & hold harmless The Grove Season, its owners, employees & contractors from any claim, loss, liability or expense, including reasonable attorneys' fees, arising out of your misuse of this website, your breach of these terms or your violation of any law or the rights of a third party.
12. Privacy
Our Privacy Policy explains what information we collect through this site, how we use it, how long we keep it & what choices you have. It forms part of these terms, & by using the site you agree to it as well.
13. Governing Law & Disputes
These terms are governed by the laws of the State of New York, without regard to its conflict of law rules.
Any dispute arising out of or relating to these terms or your use of this website will be brought exclusively in the state or federal courts located in Suffolk County, New York, & you consent to the jurisdiction of those courts.
Before filing anything, we would ask you to contact us first. Most disagreements are resolved faster by email than by either party involving lawyers.
14. Changes to These Terms
We may revise these terms as our business or the law changes. When we do, we will update the effective date at the top of this page. Changes take effect when posted, & continuing to use the site afterward means you accept the revised terms.
Changes to this page do not alter a rental agreement you have already signed.
15. General Provisions
- Severability. If any provision of these terms is found unenforceable, the remaining provisions stay in full effect.
- No waiver. If we do not enforce a provision, that is not a waiver of our right to enforce it later.
- Entire agreement. These terms, together with our Privacy Policy, are the entire agreement between you & us regarding this website. Your rental agreement, where one exists, governs your booking separately.
- Assignment. You may not transfer your rights under these terms. We may assign ours in connection with a sale or reorganization of the business.
- Headings. Section headings are for convenience only & do not affect interpretation.
